The following information concerning terms and conditions on the Website, www.diamondassure.com ("Website"), is owned and operated by Assure Brilliant Diamonds LLP (hereinafter referred as "ASSURE" or "Company" or "we" or "us" or "our" or "seller") is provided to the user/visitor ("you" or "your" or "customer" or "buyer") having its registered office at A-1002, 10th floor, A-Wing, The Capital, Opp. ICICI Head office, Bandra Kurla Complex, Bandra East, Mumbai 400051.

Please read the terms carefully before using the platform. By using the platform, you indicate your agreement to these terms. If you do not agree to these terms, you are not authorized to continue using the platform.

The information provided on the site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would violate the law or regulations, or require us to meet registration requirements in that jurisdiction or country. Therefore, individuals who choose to access the platform from other locations do so at their own discretion and are solely responsible for complying with local laws, to the extent that they are applicable.

UPDATES TO THESE TERMS AND CONDITIONS

We may make changes from time to time to these terms, so please check back regularly to keep informed of updates. The latest version of these terms will always be available on the platform. Any new version of these terms shall take effect and will govern the use of the platform and your relationship with us immediately upon the date of posting. By continuing to use the platform, you agree to be bound by the terms of these updates and amendments.

OUR PRIVACY POLICY

Our information collection practices on the platforms, such as the types of information we collect regarding visitors to the Platform and the ways in which we may use that information, are governed by the terms of our Privacy Policy.

SHIPPING DESTINATIONS

In India, we serve almost all cities.

We also offer international delivery, but please note that we do not deliver to the following countries: North Korea | Iran | Myanmar

If there is no courier service available in your area, we sincerely apologize for any inconvenience this may cause.

DELIVERY SCHEDULE

The estimated delivery date shall be provided as soon as your order is dispatched. The company will not bear any legal responsibility for the delay in delivery caused due to any force majeure event including without limitation (but not limited to) natural calamity, governmental actions, pandemic, public holidays, or any other unforeseen circumstance. It will be dealt strictly per the Delivery Partner’s Terms and Conditions ("T&C"). The order delivery policy will be governed by our Delivery Partner(s) which will be known to you once you receive the order dispatch notification in writing (by e-mail or otherwise). Thereafter, you can track the order by clicking the Track Order link (this link is given at the bottom of the Index Page / Home Page of the website www.diamondassure.com ) and find the status of your order.

The company cannot be held liable for any delays arising due to the failure in delivery by the delivery partner - either due to non-availability of the customer while the delivery attempt is made by the delivery partner or if the delivery partner is unable to contact the customer on the contact number provided at the time of placing the order. Upon such a failed delivery attempt, our delivery partner will continue to make attempts to re-deliver the parcel as per their policy.

If the customer still fails to be available to receive the parcel, then that parcel will be held by the delivery partner at the destination city for a stipulated number of days (as per the delivery partner’s T&C); thereafter they will follow the process as outlined in their T&C.

Please Note: The company will not be liable for any damages or grievance redressal if the Delivery partners are not able to meet any customer perceived expectations of the delivery timelines that has not been committed upon by our Delivery Partners at the time of placing the order.

CERTIFICATION PROCESS

As a matter of policy and established order fulfillment process by ASSURE, the services of professional inspection, selection, identification, grading, and hence the certification of diamonds is to be provided by a third-party independent laboratory which could be any of the established laboratories ("lab") including but not limited to Solitaire Gemmological Laboratories Ltd. ("SGL" or "the lab") We shall ensure that the lab has access to enough goods supplied from our side, so that they are able to make the selection and certify the selected assortment that adheres to the requirement of the attributes of the order from the customer.

ASSURE is responsible for manufacturing and meeting the criteria of the captioned goods ordered on the Website and submitting the same to the lab, whereas the third-party lab is responsible for the selection and certification in order to prepare the assortment per the quantity and quality attributes as per the paid order, and putting a tamper-proof seal on the parcels making them ready for shipment.

The third-party lab performs the selection and then the certification process of the desired number of quantity of the goods as per the order placed by the customer. After this, the certified goods are placed in a transparent pouch which shall be sealed by a tamper-proof seal by the designated lab personnel. This sealed pouch containing the goods is then placed in another outer package along with all the certification documents. This package containing the lab-certified sealed pouch is then handed over to the delivery partner. This whole process of sealing is captured in a video by the third-party independent lab which shall be available for viewing in the customer's account section on the company’s website.

INTERNATIONAL ORDERS

Delivery Terms: The tentative delivery timeline for international orders will be T+7 days.

Shipping and Handling: The customer has to bear the shipping and handling charges plus any duty as applicable at the destination. The customer has to pay the shipping charges at the time of placing the order. Also, custom duty and taxes levied by the destination country has to be borne by the customer and needs to be paid to the logistic partner at the time of delivery. Please note that all consignments are on Delivery Duty Unpaid (DDU) basis.

Payments: Payments for international orders are accepted through PayPal and/or International credit/debit cards and/or Cross-border Interbank Swift mechanism. International payments will be accepted in the designated currencies as offered on the website. The customer can choose from the list of currencies as per their convenience to save them from conversion charges wherever possible. However, there may be some transactional charges applied by your bank and we have no bearing on the same.

Custom Clearance: All shipments of goods exported from India need to be cleared by the Indian Customs office. Goods along with their complete documentation are filed with the authorized officer of the Indian Customs office for inspection, examination and assessment and only then can be delivered to your shipping address.

The Customs Officer is well within their rights to examine the goods, which might include them taking out the goods from the sealed pouch to examine in physical form. While such examinations are not frequently done but nonetheless can be carried out. In such cases, the Customs Officer upon approval of the shipment will put the goods back in the pouch. We will then try (to the best of our ability) to get the pouch re-sealed and then be put inside the outer package along with the certification documents by the appointed third-party certification lab’s personnel (like SGL). We hereby inform you that we shall not be liable (in any form or manner) if the sealed pouch is opened for inspection by the Customs Official(s).

Please Note: The tamper-proof sealed inner pouch containing the goods may or may not be opened/tempered by the Customs. As they might be satisfied by just opening the outer package and visually inspecting the sealed pouch containing the goods without having to open the seal of the pouch. You may find the outer package sealed with a label saying ‘Opened for Customs’.

DOMESTIC ORDERS

Delivery Terms: The order delivery timeline will be 2-6 days for domestic orders.

Shipping and Handling: The customer has to bear the shipping and handling charges.

Payments: Prices on our Website are subject to change without notice. Please expect that you will be charged the price for the goods and services as it is listed on the day of purchase.

For orders being shipped within India, payments are accepted only in INR through RTGS/NEFT/IMPS. The price displayed is not inclusive of CGST/SGST/IGST, as applicable. In case international bank cards are being used for domestic orders, the transaction amount will be converted to INR before the payment is accepted.

LOGISTICS SERVICE

All deliveries will be governed by the policies of our domestic and international logistic partner(s). Once the order is dispatched, you will receive a confirmation which will have the details of our delivery partner(s).

At the time of delivery, you might be required by the designated delivery partner to show your Government issued ID proof (of the country of residence) to establish your identity. Any such ID or information therein, even if retained or recorded by the delivery partner in any form or manner is not shared with ASSURE. This information is solely for the purpose of confirming your identity with the delivery partner to receive the goods. ASSURE hereby informs that it does not take / record / requests any government issued personal identification data from its customers and has not authorized any entity / person to take such data from its customers on behalf of ASSURE. We also inform that ASSURE has to go by the transactional fulfillment data (eg. name, address) provided by the customers and shares this data on an as received basis with its delivery partners. The responsibility to provide the correct data for the sake of transactional fulfillment solely rests with the customer and ASSURE cannot be held liable for any loss, grievance in any form or manner caused by incorrect data provided to ASSURE by its customers.

REGISTRATION FOR PURCHASE OF GOODS

Only individuals, firms, or companies who: (a) have reached the legal age of majority required to enter into contracts (typically eighteen in most countries); (b) possess the legal capacity to enter into contracts; and (c) use a shipping address within the countries specified by the sales channels for shipping, may place orders for goods with us.

We do not ask for any personal information to place an order, except for the following:

  • Names
  • Phone numbers
  • E-mail addresses
  • Type of business
  • Authentication data
  • Billing Addresses
  • Shipping Addresses

PRODUCT AVAILABILITY & QUANTITY

All orders placed through the sales channels are subject to availability and acceptance of such orders by us. ASSURE reserves the right to change the assortment of items offered on the Website from time to time without prior notice to the customers. ASSURE will not be liable if any product is out of stock or otherwise unavailable. For information about the order process, please refer to our section headed “Order Process”; below.

ORDER PROCESS

The order process of the Website will include the following:

  • Add to Cart: Once you have chosen the goods, you may place them in your shopping cart. You may then decide to continue shopping for other goods and add them to your shopping cart (subject to availability and quantity limits). Placing an item in your shopping cart does not guarantee availability for purchase, which is confirmed only after you make the payment and receive a written Confirmation of Order.
  • Placing of Order: When you are ready, you then proceed to “Place Order”, through your registered account or by signing up. You may also remove or add one or several goods from the shopping cart before placing the order.
  • Delivery and Review: As part of the placing order process, you add and review your order details and personal information (including name, e-mail, phone number, shipping address, and billing address) as well as the charges applied to your order. You may also apply the Promotional Code or Offers applicable to your order. You should carefully check and confirm all details on the address page before placing your order.
  • Make Payment: You then select the convenient method to make the payment and place your order.
  • Certification: Once we receive a confirmation of your payment, you will receive a Confirmation of Order and we then send your goods to the Laboratory for certification and seal.
  • Shipment: Once the Laboratory has certified the goods and sealed the parcel; it is then ready for shipment. As soon as the parcel is dispatched, you will receive a Confirmation of Shipment.

In the case of an order being placed through our other sales channels, the ASSURE representative will walk you through the steps above and verbally ask you to confirm the details of your order.

CONFIRMATION OF ORDER & SHIPMENT

Upon receiving a confirmation of your payment, we shall send you an Order Confirmation. This confirmation shall constitute our acceptance of your order and the binding sales contract.

Once the appointed third-party lab has done the selection and certification process of the desired goods as per the customer’s order attributes; the goods will then be sealed for shipping by the lab as described in the section “Certification Process”, above. The lab will issue the sealed package to the third-party logistics service provider to dispatch for shipment. Upon receiving clearance by the Customs Official(s) the package will be shipped; you will then receive a Shipment Confirmation order in writing (by e-mail or otherwise).

Please Note: In the event of any delay arising due to non-confirmation / non-receipt of the payment from the customer, ASSURE will not be held liable for any financial responsibility or any other changes in the price of the selected cart value shown on the Website before checkout.

RETURN POLICY

We have a strict “NO RETURN” and “NO EXCHANGE” policy.

CANCELLATION POLICY

Please note, if the payment is made and the goods are not shipped yet; we allow credit note up to the amount paid less the expenses and certifying charges:

  • Expense pertaining to gateway/bank charges/assortment charges.
  • Certifying charges by the external Laboratory as billed + taxed.

Once the ordered goods are shipped out, there will be no cancellations or returns made to that order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. We reserve the right to accept or reject your offer in part or in full.

The company will not bear any legal responsibility for the delay in delivery caused due to any force majeure event including without limitation (but not limited to) natural calamity, governmental actions, pandemic, public holiday or any other unforeseen circumstance. If the payment is made and for any reason we cannot honor the order, we will refund the entire payment to the extent of funds received by us. Any bank charges at the clients end will not be dealt with by us.

INVOICES

Once you have placed the order, you will receive a Proforma Invoice that will have the following details:

  • Seller: Name, contact details (phone number and email ID), address, bank details
  • Goods description
  • Proforma invoice number
  • HSN Code
  • Order URN (unique reference number)
  • Order number (if applicable)
  • Buyer: Name, contact details (phone number and email ID), billing and shipping address
  • Buyer: CGST / SGST / IGST / SEZ / VAT number (if applicable)
  • Company’s Terms and Conditions

The third-party lab performs the selection and certification process of the desired number of quantity of the goods as per the order placed by the customer. Once the certification number is generated by the lab (post the certification process by the lab), the final invoice is created and sent to the customer.

The final Invoice will have the following details

  • Seller: Name, contact details (phone number and email ID), address, bank details
  • Goods description
  • Final invoice number
  • HSN Code
  • Order URN (unique reference number)
  • Order number (if applicable)
  • Certification details including the certification number of the sealed pouch provided by the third-party lab
  • Logistic partner’s details
  • Buyer: Name, contact details (phone number and email ID), billing and shipping address
  • Buyer: CGST / SGST / IGST / SEZ / VAT number (if applicable)
  • Company’s Terms and Conditions

These invoices shall be shared with you in writing (to your e-mail address as a PDF attachment or otherwise).

RESTRICTION

ASSURE reserves the right, at its sole discretion, to limit the quantity/value of the items purchased by you and such other restrictions as may be applicable to orders placed by the same account, the same credit/debit card and also to orders that use the same billing and/ or shipping address. We will provide notification to the customer should such limits be applied. ASSURE reserves the right at its sole discretion to prohibit sale of goods to anyone as it may deem fit.

FRAUDULENT TRANSACTIONS

ASSURE reserves the right to recover the cost of goods, collection charges, damages caused to ASSURE and legal expenses from persons using this Website fraudulently. ASSURE reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these Terms and Conditions.

EXTERNAL MATERIAL AND LINKS

The Website may contain links to other Websites; these external Websites are not under our control. We cannot be held responsible for such Websites and cannot make any warranties about them. We provide these links because we think they might interest you, but we do not monitor or endorse these Websites.

LIMITATIONS OF LIABILITY

In no event will we or our directors, employees, or agents be liable to you or any third-party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Website, even if we have been advised of the possibility of such damages

INDEMNIFICATION

By using the Website, you agree to hold harmless, defend and indemnify ASSURE and its associates, employees, third-parties, and contractors from and against any claims for damages, costs, liabilities, expenses, attorney's fees, etc. that arise or may arise from your use of the Website, our services, our goods, or any part of any of the foregoing.

ASSURE reserves the right to confirm and validate the information and other details provided by you at any point in time. Further, ASSURE also reserves the right to ask for additional information for accepting orders or before making delivery in certain cases. If upon confirmation, your details are found to be false (partially or completely) or if you provide any information that is false, inaccurate, incomplete or not current or if ASSURE has reasonable grounds to suspect that such information is false, inaccurate, incomplete, not current or not in accordance with these Terms and Conditions, we have the right to indefinitely suspend or terminate any services provided to you and refuse to provide you with access to our Website and other affiliated services without any prior intimation whatsoever.
  • You confirm that the address at which delivery of the goods is ordered by you is correct and proper in all aspects. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information), any extra cost incurred by ASSURE for re-delivery shall be claimed from you and you shall bear such expenses.
  • Before placing an order you shall check the product description carefully. By placing an order for the goods, you agree to be bound by these terms and conditions; an invitation to offer included in the goods description.
  • By entering your payment information and submitting your order, you authorize us and our third-party payment processors to charge the amount of the order to your selected payment method.
  • Any product you buy from our sales channels is completely at your discretion and you accept that you place the order only after thoroughly inquiring about the product and being completely acquainted about the product,
